What the store is required to do
Businesses must inspect their premises regularly, clean up hazards within a reasonable time, and warn customers about dangers that can't be fixed immediately — that's what the yellow cone is for. When a store skips those steps and someone gets hurt, the law calls that negligence.
For spills and other transitory hazards, Florida law asks a specific question: did the business know about the danger, or should it have known because it existed long enough that reasonable staff would have found it? Evidence like inspection logs, surveillance footage, and employee statements usually holds the answer.
Why the first two weeks matter
Here's the hard truth about these cases: the evidence belongs to the store. Camera footage gets overwritten, floors get mopped, and incident reports get written by employees — often within days.
